Amber Heard says Johnny Depp became violent out of jealousy

Aquaman actor Amber Heard testified for a second day on Thursday (Friday morning AEST) in the widely-followed defamation case brought by her ex-husband Johnny Depp, describing times she said he kicked her in the back and injured her nose when he felt jealous.

In one case, she said Depp became upset when he learned she had kissed actor James Franco for a scene in 2015 movie The Adderall Diaries.

On board a private plane, Depp called Heard a “slut” and asked in sexually explicit language what Franco “had done to my body,” she said, adding that Depp smelled like weed and alcohol.

Depp denies he was physically abusive to Heard. In his earlier testimony, he said he never hit Heard and alleged that she was the abusive one in the relationship.

Depp allegedly slapped and kicked Heard over James Franco

Heard alleged that Depp once kicked her in the back during a fight about James Franco, with whom Heard had a working relationship – a fact that Depp allegedly hated.

“He called me a slut,” Heard recalled of Depp regarding the loves scenes she shared with Franco in The Adderall Diaries.

Depp allegedly accused Heard of liking filming the sex scenes when the two were on a flight to Los Angeles from Boston with other people.

Heard told the court that when Depp had once passed out with his iPad on his lap, she saw text messages from Depp to another woman.

“He was texting this woman that he had a relationship on and off… The date was right after our wedding. I had seen that he had gone to her house after our wedding,” Heard said.

After she found the texts, Heard said she “freaked out” and “immediately confronted him about it.”

“I didn’t care in this moment if he did kill me,” Heard said of the confrontation.

The identity of the other woman remains unknown.

Heard punched Depp in the face to ‘protect’ her sister

Heard said out of fear that Depp was going to push her sister Whitney down the stairs, she punched Depp in the face.

The couple had been fighting in the mezzanine of the staircase in one of Depp’s penthouses and Whitney got in between them.

“I remembered what happened to Kate Moss,” Heard said in reference to Depp pushing the model once down a flight of stairs.

It was, according to Heard, the first time she had ever “landed” a hit on Depp, and he started laughing after she punched him. Security did intervene.

When Depp and his witnesses testified a few weeks ago about the same moment, they claimed Heard instigated the attack and Depp did not do anything in return.

Depp allegedly beat Heard so badly once she thought she was going to die

In December 2015, Heard alleges that Depp beat her so badly she thought she was going to die.

“I thought ‘this is how I die’,” Heard told the jury. “He is going to kill me and he won’t even have realised it.

“I just could hear myself scream until I couldn’t hear myself anymore. I could just hear him say he was going to kill me.

“And that he sounded like an animal in pain when he was saying … he f—ing hated me.”

Heard’s hair had been ripped out in chunks

The court was shown photos of Heard’s hair, which she testified had been “ripped out in chunks” in December 2015 during a fight with Depp where he allegedly dragged her and punched her.

“My head was bleeding from the ripped out hair chunks of hair on the floor all over the place” Heard said. “He busted my lip when he punched me.”

Depp broke their bed during a fight

Depp allegedly broke the couple’s shared bed while he was “beating me up,” Heard told the court, during a fight on December 15, 2015.

This is the same fight where he allegedly gave her two black eyes, pulled out chunks of her hair, and busted her lip.

“That’s the bed that Johnny broke while on top of me,” Heard said when she was shown a photo of the bed in court.

Flight to Los Angeles from Boston

Heard said she switched seats several times during the flight from Boston to Los Angeles where her working relationship with Franco was brought up, and Depp threw ice cubes and utensils at her, and allegedly slapped her in the face.

“It didn’t hurt my face, I just felt embarrassed that he would do that to me in front of others,” Heard said. Depp also allegedly started to taunt her on the flight and call her names.

At one point, Heard alleged that Depp came behind her and kicked her in the back. Security guards and staff on the plane did not react, she added.

“I was embarrassed that he could kick me to the ground in front of people,” Heard said.

Depp reportedly began to squirm in his seat in court as she recalled this incident.

“No one said anything, no one did anything,” Heard said. “You could hear a pin drop… I felt so embarrassed that he could kick me to the ground in front of people. And more embarrassing, I didn’t know what to do about it.”

Heard said: “He hated James Franco. He was accusing me of having a thing with him in the past since I had filmed Pineapple Express with him.”

An audio recording of Depp “howling like an animal” – recorded by Heard during the flight – was played for the jury.

After the alleged incidents of violence, Heard said Depp locked himself in the bathroom on the plane and passed out.

Heard said she recorded the howling and documented his behaviour as she “knew Johnny wouldn’t remember what he had done.”

Depp was allegedly ‘bashing’ Heard ‘against the wall’ during their Australia trip, which is where he allegedly assaulted her with a bottle

Heard and Depp’s infamous Australia trip in 2015 – where the couple clashed with Barnaby Joyce, and during which Depp lost the tip of a finger – was violent from the beginning, according to Heard.

During their trip, Depp allegedly started shoving Heard “up against the fridge, has me up against the throat, bashing me against the wall, the fridge.”

“I don’t remember the exact sequence of things, I wish I did,” Heard said. “When he shoved me, I went skidding across the floors … I just slid, breaching my skin against this beautiful wooden floor.”

Heard said that after that fight, she barricaded herself in a room in the couple’s rented house and took a sleeping pill to fall asleep.

When she woke up, she realised Depp had not slept after the fight and allegedly took between eight to 10 pills of MDMA.

Heard said there was also “a lot of name-calling” and alleged that Depp called her a “whore, slut, fat-ass.”

It was during this trip that Depp allegedly inserted a bottle inside Heard, and describing this incident on the stand is when Heard broke down into heaving sobs.

“I can’t believe I have to do this,” Heard said when Elaine Bredehoft, her lawyer, asked her if Depp had penetrated her vagina with a liquor bottle, all the way to her pubic bone.

Heard said Depp shoved the bottle inside her repeatedly, and said she was bleeding from her vagina in the aftermath of the alleged incident.

“I didn’t know if the bottle he had inside me was broken,” Heard said. “I couldn’t feel it. I couldn’t feel anything.”

Heard testified that before this incident, Depp had held up a broken bottle to her face and threatened to cut her with it.

“My nightgown came completely off, it was ripped off of me,” Heard cried, saying that Depp was punching the wall next to her head.

“I was naked, slipping around on this tile,” Heard continued. “He’s screaming at me and saying I ruined his life.”

“‘I f–king hate you. You ruined my f–king life,'” Depp allegedly screamed at Heard as he smashed a phone “to smithereens.”

“I’m looking in his eyes, I don’t see him anymore,” Heard sobbed. “It wasn’t him. It was black. I’ve never been so scared in my life. I was trying to get through to Johnny and I couldn’t see him at all.”

Heard seemingly addressed the court with an “I’m sorry” as she breathed rapidly.

After the alleged assault with a liquor bottle, Heard said she woke up and found Depp with his finger severed.

“I figured out he was missing a finger,” Heard said, describing the house in Australia having dried blood on the walls and blue paint.

Depp had allegedly written a message in blood for Heard on the walls, and although she could not decipher what it was, she said it was clear it was for her. There were so many messages written with the blood from Depp’s severed finger on a pillow, mirrors and walls, Heard said, that “it looked like he had run out of blood.”

When he ran out of blood, Heard said it looked like he got paint.

During Heard’s testimony, Depp started laughing in court when she said “he took his penis out of his pants” and tried to urinate after the incident.

Heard also testified that there was food scattered around the entire home the couple had rented, including pieces of steak put in her clothes.

The court was shown photos of the trashed house in Australia, and one image showed an area of the bar where Heard said Depp started “bashing me against the wall” after he grabbed her by the throat.

A broken window was shown in another image, and Heard said Depp smashed her phone to bits, which is how she believes his finger was severed.

Photographs of blood-stained duvet covers, a couch, white sheets and guitars were also shown to the court, as was a broken lamp and an area where Depp allegedly slammed the end of a bottle into a wall.

After the alleged attack, Depp holed himself up in another part of the home and blared Marilyn Manson music, Heard said.

An image of a collapsed game table was shown to the court, which Heard said collapsed “when Johnny threw me into it and got on top of me. Or fell on top of me. I honestly don’t remember which one.”

“He was covered in paint,” Heard said when she was shown a photo of paintings she says Depp destroyed, including one she was working on with his daughter Lily-Rose Depp.

Depp allegedly told Heard ‘the only way out of this is death’

When Heard asked Depp if they should sign a prenuptial agreement after their 2013 engagement, the actress alleges that Depp told her that “the only way out of this is death.”

The Zombieland star said she wanted to sign a prenup because she knew Depp was significantly wealthier than she, and it was important to her that she showed she was in the relationship for the right reasons.

“I wanted to eliminate any doubt in his mind and in other people’s minds. So I brought it up to him and brought it up to my therapist,” Heard told the court.

Heard said that Depp told her he would “tear it up” and “accused [her] of having one foot out.”

Depp allegedly did drugs with Heard’s father at their engagement party

Heard testified that her father and Depp did drugs together at their engagement party, with her father leaving the party with Depp’s security to pick up more drugs for them to share after the pair had run out.

The actress said she did not know what drugs they were doing. She only knows that her father and Depp were addicted to the same drug at the time.

Heard ‘suspected’ Depp broke her nose after the Met Gala in 2014

Heard recalled Depp accusing her of flirting with someone at the 2014 Met Gala in New York.

“At the Met Gala, he was accusing me of flirting with a woman. We get back to the hotel room, he shoves me and grabs my collarbone. I remember he threw a bottle at me, missed me, hit the chandelier,” Heard, who is bisexual, told the court.

In their hotel room after the event, she said he shoved her and the pair struggled. Heard alleged Depp punched her, and she believed her nose was broken as a result.

“At some point, he just whacked me in the face,” Heard alleged.

“I was unsure what that feeling was but I suspected I had a broken nose. And other than that I remember my nose being swollen in discoloured.”

Heard went through ‘hell’ during Depp’s detox in the Bahamas

Heard described Depp trying to detox from Roxicodone in August 2014, saying her trip with him to the Bahamas was “hell” as a result.

Over the week-long trip, Heard said Depp went “up and down” and at times, would scream at her and tried to flip a table that was bolted to the floor, but other times he would act “calm and sweet.”

“He went up, down … mad,” she told the court. “He wanted to have sex a lot, which is not like Johnny at all.”

One time, Heard recalled Depp saying he wanted to “quit” the detox, and when Heard tried to encourage him to continue with it, he allegedly got violent.

“I said something to him and he got so angry at me, he slapped me across the face,” Heard said. “He was crying, saying no woman had ever embarrassed him like that, had ever made him feel like that.”

During the trip, Heard says Depp accused her of hiding a man in the house, but they were staying in a cabin together on Depp’s island.

“I had no idea what that was going to look like,” Heard told the jury of why she went on the trip. “It was hell.”

When the couple were spending Christmas on Depp’s island in the Bahamas in 2015 with his kids, Heard told the jury Depp threatened to kill her.

“If you ever embarrass me in front of my kids I’ll f–king kill you,” Heard said Depp told her.

“I knew I needed to get away from him, and at some point I ran.”

Heard told the jury she started to document Depp’s drug and alcohol use, because she felt nobody believed her or confronted the problem.

“There was no one to back me up. Just his employees and everyone who backed him up against me. So I started to take pictures,” Heard said.

The jury was shown several photos of Depp passed out in multiple locations, including one that was taken when he was on a press tour in Tokyo in 2013 for The Lone Ranger.

“He had a bit of sobriety before this,” she continued. “And it started to change with his friend Paul Bettany.”

Depp allegedly was “wailing on [Heard]” and “left [Heard] on the closet floor” in a hotel room in Tokyo in 2015, right before the former couple walked the red carpet for the premiere of Mortdecai in Japan.

“He was screaming at me that it was over,” Heard told the court after the lunch break. “He didn’t want to marry me. You made this mistake, it was a big mistake and everybody hated me. And I remember crying on the floor. More than anything, I was heartbroken.”

Heard recalled “checking for bruises” and “making sure there would me no marks on me” on the way to the premiere as she was wearing a backless dress to the event.

Heard says Depp hit ‘rock bottom’ in 2013

Recalling the moment she thought Depp “finally hit rock bottom” in 2013, Heard said Depp was carried home “like a baby” by his security guards in London during their autumn, when he was filming the movie Mortdecai.

“I watched this … and the other security guards shaking their head, you know, just shaking your head acknowledging ‘This is how bad it is,'” Heard said. “And I remember thinking this is gonna be like, ‘This is gonna change this. Surely.'”

Heard said that after having a conversation with Depp’s team, “I felt very encouraged that everybody and myself were on the same page, and I felt encouraged that we were in a new chapter.”

“That finally he felt like changing for good. I felt buoyed, supported by the conversations I was having with people that he was close to.”

Heard said she went to support group over Depp’s addiction

Heard testified she went to meetings every day with a “support group for people who loves addicts and alcoholics” in 2014 after the alleged plane incident, where Depp allegedly slapped and kicked her in front of his entourage, who did “nothing.”

Al-Anon assists families and friends of addicts to cope with the effects of their loved one’s disease.

Lead up to the divorce

Heard said that her relationship with Depp grew more volatile and abusive from 2014 to 2016, which is when she filed for divorce.

“I tried for over a year, maybe two, of just not responding physically, not responding verbally,” Heard said.

“By this point in our relationship, we were both saying awful things to each other. Screaming at each other.

“Unfortunately when Johnny would start hitting me, he would just win.”

Heard says her career suffered when she was with Depp

The actress says her career suffered during the time she was in a relationship with Depp, as she alleges he would grow upset if he knew she was reading scripts for new roles, especially so if the scripts involved sex scenes.

“Every time I got a script, it was what kind of, you know, how I was dressing? … Did I have a sex scene?” Heard said, adding that she stopped taking more sultry roles and when she was on set, would try to convince the wardrobe departments to allow her to dress more conservatively.

She also said Depp did not want her to work at all, but she wanted to work.

“He would say, ‘You don’t need to work, kid. I’ll support you,'” Heard said on the stand.

Marrying Depp was not a simple decision for Heard

“I was marrying the love of my life,” Heard told the jury, though she acknowledged it was not a simple decision when she married Depp in 2015. “It was complicated but I thought he was the love of my life.”

A small wedding ceremony was held for the couple at Depp’s mother’s house in Los Angeles, and then a bigger ceremony on Depp’s island in the Bahamas.

Heard also detailed her wedding to Depp in 2015, which she says happened without a wedding ring.

“I just said to him over and over again. ‘Are you serious? Are you serious? Are you sure? You didn’t have a ring?'” Heard said. “I thought: ‘Is this an impulse?'”

She described how she felt so “lucky” when the pair got engaged in September 2013, crying as she recalled Depp flying her father out to London to ask his permission to marry her.

“I had butterflies … Dad said, ‘Johnny has asked me for your hand in marriage.’ I felt like the luckiest girl in the world,” Heard said.

Heard ‘lost a piece of myself’ due to alleged abuse

Towards the end of her day-long testimony, Heard told the court she “lost a piece of myself” in her relationship with Depp.

“A piece of my self-confidence” was taken by Depp’s alleged abuse “for every single time I went back or allowed him back,” she said.

“It was easier to stay,” Heard said. “I didn’t want to stay in the violence, I wanted to stay in the good Johnny that I loved.”

After the December 15, 2015 fight, Heard said Depp told her he would get sober again.

“I just decided to believe him,” Heard told the court. “This time was the last time because it couldn’t be worse than this, right?”

Heard had told the jury on Wednesday that Depp assaulted her multiple times before and during their brief marriage.

Depp, 58, testified earlier in the trial that he never hit Heard and argued that she was the one who was the abuser.

The star of the Pirates of the Caribbean films is suing Heard, 36, for US$50 million (approx. $70.5 million), saying she defamed him when she claimed she was a victim of domestic abuse. Heard has counter-sued for US$100 million (approx. $141 million), arguing Depp smeared her by calling her a liar.

The case hinges on a December 2018 opinion piece Heard authored in The Washington Post. The article never mentioned Depp by name, but his lawyer told jurors it was clear Heard was referencing him. The couple’s divorce was finalised in 2017 after less than two years of marriage.

Depp, once among Hollywood’s biggest stars, said Heard’s allegations cost him “everything.” A new Pirates movie was put on hold, and Depp was replaced in the Fantastic Beasts film franchise, a Harry Potter spinoff.

Heard’s attorneys have argued that she told the truth and that her opinion was protected free speech under the US Constitution’s First Amendment.

A state court judge in Virginia’s Fairfax County, outside the nation’s capital, is overseeing the trial, which is expected to last until late May.

Less than two years ago, Depp lost a libel case against The Sun, a British tabloid that labeled him a “wife beater”. A London High Court judge ruled he had repeatedly assaulted Heard.

Depp’s lawyers have said they filed the US case in Fairfax County because The Washington Post is printed there. The newspaper is not a defendant.

After today’s hearing, the Virginia court will take a one-week recess, and resume sessions on May 16.
